Single Dwelling & Small Second Dwelling Code – Changes to Clause 54 (VC282)
Amendment VC282 relates to the introduction of the Single Dwelling and Small Second Dwelling Code, effective from September 8th, 2025. This update brings significant changes to Clause 54, aimed at streamlining approvals for single dwellings and small second dwellings, particularly on lots under 300 m².
Key Highlights of the New Code:
- Deem-to-Comply Requirements: Applications that meet all Clause 54 standards are now eligible for VicSmart approval (subject to the overlays that impact the property), offering a 10-day turnaround for eligible applications with no advertising or third-party review. This does not apply to development within DDO’s.
- Updated Design Standards: Revised requirements for street setbacks, site coverage, private open space, and tree planting have been introduced. For example, the front setback requirement is now 6m, and site coverage limits vary by zone (60%–70%).
- Tree Planting Obligations: One canopy tree per 100 m² of site area (up to three trees for lots between 200–300 m²).
- Focus on Sustainability: Enhanced solar access and overshadowing controls promote energy efficiency and responsible urban development.
The Building Regulations have yet to be amended to reflect the changes adopted to Planning Schemes so until this occurs there is a difference between the planning and building requirements for single dwellings.
